A decision to refuse a planning application at an award-winning Italian delicatessen and cafe in St Albans has been labelled an "utter disgrace".

The planning committee at St Albans District Council refused the application from Alan Oakley to change the use from shop to residential at 68 Lattimore Road, the home of popular Italian deli Buongiorno Italia.

Mr Oakley also applied for a two storey extension and rear basement extension, which if approved would have meant the forced downsizing, and possible closure, of the delicatessan and coffee bar.

Buongiorno Italia owner Mr Picciuto was told before the meeting the council’s planning department could find no reason to refuse permission, despite a 1,600-signature petition.

However, at a planning meeting held at the council offices in Civic Close, the application was refused after a one hour debate.

Batchwood Labour councillor Malachy Pakenham said the decision was "ludicrous", and meant local taxpayers would have to pay out around £5,000 if the council loses an appeal.

He said: "The meeting was an absolute farce.

"In my 15 years on the council I have seldom seen such a stupid decision. It's an utter discrage.

"None of the councillors who called in the plans turned up, becausee they knew it was a weak case."

Councillor Pakenham, who sits on the planning committee, said there was no lawful planning reason for refusal.

He added: "I am very sympathetic with the shop - but this was not the correct decision.

"This is why I do not think planning meetings should be held close to the election, the decisions become political.

"It's so wrong that local taxpayers will pick up a bill when the house owner has a legal right to do what he wants."
