CAMPAIGNERS opposing plans for a huge railfreight depot which could be built on the Green Belt in Radlett say they are prepared for the High Court battle.
Developer Helioslough launched a legal challenge against the Secretary of State's decision to dismiss their appeal after planning permission for the railfreight terminal was refused.
A two-day High Court battle has been set for June 28 and campaign group STRiFE, which was facing a court freeze-out, said it is ready to embark on the challenge.
Cathy Bolshaw, group leader, provided an update on the situation.
She said: “Helioslough tried to prevent STRiFE from being classed an 'interested party' in the case but, following legal representations from our own lawyer, STRiFE has now been formally granted interested party status by the court.
“This enables STRiFE to be properly represented and we believe that we have a useful role to play in supporting the arguments put forward by the Secretary of State and St Albans District Council.
“As with the previous public inquiries, STRiFE will again be engaging barrister, Paul Stinchcombe, to assist us.”
Cathy added: “So far, we have been successful in raising substantial funds from all of our many supporters for which we are extremely grateful as this will allow us to maximise the effectiveness of our participation in the proceedings.
“In devising our strategy for this next stage of our campaign, we are trying to look ahead to what may follow this challenge, win or lose.
“A win for Helioslough in this challenge will not mean that they will automatically be granted consent for the development but more likely will result in the Public Inquiry being recalled to reconsider evidence both new and old. STRiFE will certainly wish to participate in this.
“A loss for Helioslough may also not be the end of it as Helioslough may yet in time come back with yet another further planning application.
“Whichever way the High Court challenge ends, STRiFE will continue to fight these proposals on your and the community’s behalf.
“We will keep you informed of further progress and very many thanks again for your continued support.”
