A good time to Divorce?
When asked whether it’s a good time to divorce, I can only respond by asking "Has your marriage irretrievably broken down?" I know that this is not what the client wants to hear. The fact is that if a spouse can bear it, the divorce is delayed until the matrimonial pot is looking healthier (or not, if you are the provider). Savings, shares, salaries and house prices should increase, resulting in there being more in the pot to share. That’s the theory.
The court favours clean break orders where possible and most spouses do prefer to have one final clean break settlement. However, if one of you is financially dependent it is unlikely that you are going to achieve a clean break in any event. The options are to divorce now and leave some financial claims open or delay the divorce until you feel rich enough to have a clean break.
Spare a thought for children who may be in the house. Spare a thought for your general health being in a marriage that has broken down irretrievably. There are many things that a good divorce solicitor can negotiate these days to equip you financially for your ‘new life’ whether we are in a recession or not. If the marriage is truly over, don’t let finances hold you back.
There are so many groups and services available to help divorcees and single parents that you need not fear being alone. If you want the help, support and a social life, it is out there, I promise!
Staying in a marriage for the sake of the children is unlikely to be in their best interests. Speak to any child who has lived amongst battling parents.
I’m not encouraging people to divorce without due thought and consideration. If there is a chance to reconcile and make amends that should be explored. I know a great Relate counsellor!
