Some advice if you are thinking about surrogacy in India


1 Do your research when choosing a clinic.  Speak to other British couples who have been through the process with the same clinic that you have chosen.   The clinic should be happy to give out references.  I too can refer you to some clients who may have used the same clinic.  Avoid agencies / agents who charge a referral fee.  

2 Contact me for advice before you start the process.  If you are a British citizen, you are subject to the law in this country.  The surrogate is the legal mother to the child(ren) and her husband is the legal father.  Providing that one of you is biologically connected to the child, you may become the legal parents by obtaining Parental Order. The birth certificate issued to you in India does not confer any legal rights to you under English law. 

3 I can take you through the Parental Order process swiftly and it need not be expensive.  I understand that you have probably already spent a fortune trying to conceive in the UK.  I’ve been there!  I can provide you with references from several British couples at your request.

4 Get legal advice from a lawyer in India to advise on the position pre and post birth.  You may also need some assistance with immigration to return to the UK with your child(ren).  You also need to know about the medical visa requirements. 

5 If you do not apply for a Parental Order, you have no legal right to retain the child(ren) in the UK.  If you do not apply for a parental order by the time the child is 6 months old, you may need to go through a formal adoption process.
